This page states the Terms and Conditions under which the client, you (“You”) may use 24/7 Prestige Transportation and Courier Services, LLC (“We” or “Prestige”Website’) located at https://www.247prestigetransportation.com/ (“Website,”) and under which you may use Prestige private transportation services (“Services” or “Ride”). We may update this posting and may modify these Terms and Conditions at any time, at our discretion and without notice. YOUR USE OF THE SERVICES AND THIS WEBSITE IS SUBJECT TO THE TERMS AND CONDITIONS STIPULATED HEREIN. USAGE OF SERVICES AND THIS WEBSITE SIGNIFIES YOUR ACCEPTANCE OF THESE TERMS AND CONDITIONS.

Our Services
We provide transportation services to individuals and companies in the Tri-State Area. Transportation services are provided in clean and comfortable vehicles with experienced drivers. We provide transportation to and from the airports in the Tri-State Area, transportation to special events, and other specific needs for You.

Services Requests
Services RequestsWe reserve the right to refuse any request you place with us for any reason whatsoever. We may, in our sole discretion, cancel Service or modify quotes for Services per person, per household or per order. These restrictions may include requests placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event we make a change in a quote or cancel a request, we will attempt to notify you twenty-four (24) hours in advance by contacting the email and/or phone number provided at the time the request was made. We reserve the right to cancel requests due to dangerous weather conditions, illness or other personal limitations of drivers, and/or to change quotes due to changes in the Services requests or cancel orders that, in our sole judgment, appear to be placed by dealers, resellers, distributors or other third parties.

Conditions of Service

• Communication. You shall provide accurate and complete information when booking services and will be present at the designated pickup location at the scheduled time.
• Age and Authority. Prestige Services are provided to individuals who are at least 18 years of age and who can form legally binding contracts under applicable law. Individuals under the age of 18 must use our Services under the express consent of an adult parent or legal guardian. In all such cases, the adult is the contracting party and is responsible under these Terms. Individuals who use the Services on behalf of a corporate entity, represent and warrant that they have the authority to bind that entity. By using the Services, You represent and warrant that You have the right to enter into these Terms and allow Us to perform the Services and You are not barred from using the Services under the laws of the jurisdiction of New Jersey.
• Compensation. You are responsible for all fees, costs and applicable taxes associated with using Prestige Services. The Service fee will be provided at the time of booking the Ride, and may not include taxes and additional fees that may apply. Payment for the Ride will be made online through Your website account prior to Ride. If You provide credit card, PayPal or other means of payment information, then You represent and warrant that You are authorized to supply such information and hereby authorize Us to charge Your credit card, PayPal or other means of payment on a regular basis to pay Prestige fees as they are due. If Your payment method fails or Your account is past due, then Prestige may collect fees owed using all collection mechanisms, including charging other payment methods on file with Prestige and/or retaining collection agencies and legal counsel.
• Compliance. You represent, warrants and agree that while using Services You will comply with all safety instructions and regulations. You, and all passengers included in the reservation will have seatbelts on at all times. You will at all times be in compliance with all applicable rules, regulations and laws (including the laws relating to the intellectual property rights of others, privacy, hate propaganda and import/export restrictions). The use of Services is also conditional upon You abiding by these Terms.
• Service Animals and Pets. Service animals are permitted in accordance with applicable laws, and with notice by You upon booking services. Other animals may be transported only with approval prior to the Ride and in appropriate carriers.
• Acceptable Use of Services. By engaging in the Services, You warrant and represents that You will not:
  • Behave in any way that may endanger You, the driver, or any other person inside or outside the vehicle.
  • Behave in any way that may damage or deface the Prestige Transportation vehicles or property.
  • Smoke electronic and non-electronic cigarettes, vapes, and other types of cigarettes inside the vehicle; consume alcohol; or use illegal substances in Prestige vehicles.
  • Consume any type of food inside the vehicle.
  • Engage in or use Services for any unlawful activity or purpose.
  • Bring weapons or hazardous materials into Prestige Transportation vehicles.
  • Violation of this Provision. Violation of this Condition of Services may result in suspension or termination of services, legal action, or other remedies available to the Company.

Reservation and Cancellation Policy

• You are responsible for making accurate reservations including the time, location, amount of people and property for whom reservation is made, and if any accommodation is necessary for the Ride. You are responsible for providing timely notice of any changes or cancellations.
• Cancellation fees may apply, if You cancel the Ride less than twelve (12) hours prior to the Ride, cancelation may result in fee of up to ten percent (10%) of booking. If you cancel the Ride after the driver has begun driving to the pick-up location, cancelation will result in a fee of fifty percent (50%) of the booking.
• Prestige may cancel the reservation prior to pick up due to extreme and dangerous weather conditions. Prestige reserves the right to decide when such conditions apply. In the event the Ride had been canceled by Prestige, You will be refunded for the Ride.

Gratuity
Gratuity is not included in the fare and is at your discretion. Our drivers appreciate tips and accept cash or Venmo. Corporate clients may ask the reservations team to add gratuity to the invoice for expense purposes.

Accessibility accommodations for passengers with disabilities
Prestige is committed to accommodations for passengers with disabilities. If You require special assistance, You must notify Us of any specific needs or accommodations at the time of booking, and provide detailed information regarding the type of assistance required to facilitate proper accommodations. Prestige shall provide reasonable modifications and adjustments to its services to ensure accessibility, including but not limited to accessible vehicles equipped with ramps, lifts, or other necessary adaptations.

Car Seats
All passengers must be seated in a car seat appropriate to their age, height, weight and needs. Car seats may be requested at the time You place your reservation and are subject to availability and an additional charge. You may also use your own car seat. You will be responsible for installation of the car seat, and for properly buckling your child or infant into the car seat. By using a car seat supplied by driver, You hereby release Us and driver from any claims, causes of action, damages or other liabilities, including without limitation those that result in death, injury and/or property damage, resulting from such use, including without limitation those caused due to improper use, improper installation, and defects in design and manufacture.

Personal Property
You must inform Prestige at least twelve (12) hours prior to pick up about the amount of luggage and personal property (“Property”) You will be bringing onboard for a proper size vehicle to be sent for pick up. Where an additional vehicle will be required to accommodate Property, an additional fee will be charged based on the type of vehicle and the mileage for the Service.

You understand and agree that it is your responsibility to ensure that You remove your property from the vehicle when disembarking. Should You leave your property in the vehicle, the employee of Prestige may return your Property to You, or to Prestige. While we will make reasonable efforts to return your Property to You, Prestige shall not be held liable in the event your property is lost or mishandled. Moreover, Prestige shall not be liable for the loss or damage to your Property while it is in transit.

While Prestige will take reasonable steps to locate the owner of any property left in a vehicle if returned to Prestige offices, when your property is in Prestige’s possession, You understand and agree that: (i) Prestige will only keep your property in its possession for a maximum period of three months from the date of your Ride; and (ii) should You fail to collect your property from Prestige before the end of the three month period stipulated, Prestige will be entitled to discard your Property as it deems fit and You shall have no claim whatsoever against Prestige in respect of your unclaimed property.

Wait Time and Additional Stops
Where Services provided require driver to wait for You, wait time service will be calculated at an hourly rate of fifty dollars ($50.00) per hour. Where the driver is waiting for an incoming flight, the first hour following the time of arrival will be free of charge. Any additional waiting time will be calculated at a fifteen (15) minutes increments to be added to the invoice.

If Your request an additional stop prior, to or during the Ride, an additional charge will be calculated based on the additional mileage. Prestige reserves the right to reject such request in its sole discretion.

Damage Fee – Cleaning Fee and Tampering FeeIn the event that Prestige is informed that You have damaged or stained the vehicle in any manner, You are agreeing to pay a “Damage Charge” or “Cleaning Charge” to Prestige. For stains and/or damages that result out of the consumption of food and/or beverage in the vehicle, You are agreeing to Cleaning Charge in the amount of seventy-five dollars ($75.00). For stains and/or damages that results of human or pet bodily fluids, You agree to a Cleaning Charge in the amount of five hundred dollars ($500.00). For any other damages You agree to pay a “Damage Charge” of either one hundred dollars ($100.00) or two hundred fifty dollars ($250.00) depending on the extent of the damage (as determined by Prestige in its sole discretion). The Cleaning and Damage Charge shall constitute payment to Prestige for repairing or cleaning the vehicle, or otherwise remediating the damage. In the event that damage expenses incurred exceed the Damage Charge collected by Prestige, Prestige reserves the right to collect additional fees.

West PointReservations to or from the West Point Military Academy require fifty dollars ($50.00) deposit, which will be applied to your reservation. The deposit is fully refundable if the Services are cancelled at least forty-eight (48) hours in advance. Prestige will accommodate shared rides to and from West Point Military Academy only, and fare rates will be calculated based on the destination and the number of people per ride.

Privacy These Terms and Conditions include Prestige Transportation, LLC’s Privacy Policy, located at https://www.247prestigetransportation.com/privacy-policy/, which is incorporated herein by reference and therefore, also governs your visit to and use of this Website.

Terms and Conditions Can Change We may update this posting and may modify these Terms and Conditions at any time, at OUR discretion and without notice. We may also, in our sole discretion, without any obligation and without any notice requirement, change, improve or correct the information, materials and descriptions on this Website and suspend and/or deny access to this Website for scheduled or unscheduled maintenance, upgrades, improvements or corrections. The information and materials on this Website may contain typographical errors or inaccuracies. Any dated information is published as of its date only, and We do not undertake any obligation or responsibility to update or amend any such information. Prestige shall not be liable for any damages, liability or losses arising out of lack of or improper installation or use of child restraint systems for guests on rides requested through the services for whom a child restraint system is legally required.

Prestige shall not be liable to you whether in contract or tort, for any direct, special, indirect, consequential or incidental damages or any other damages of any kind even if We or any other related party has been advised of the possibility thereof. This limitation on liability includes, but is not limited to damage to property that may occur from the use of the Website, such as viruses which may infect your equipment, failure of mechanical or electronic equipment or communication lines, or other interconnect problems (e.g., you cannot access your internet service provider), unauthorized access, theft, operator errors, strikes or other labor problems or any force majeure. Prestige cannot and does not guarantee continuous, uninterrupted or secure access to this Website.

Any cause of action you may have with respect to your use of any Service or this Website must be commenced within one (1) year after the claim or cause of action arises.

Governing Law These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to conflicts of laws provisions. Sole and exclusive jurisdiction for any action or proceeding arising out of or related to these Terms and Conditions shall be in an appropriate state or federal court located in Hunterdon and the State of New Jersey

Any cause of action you may have with respect to your use of this Website must be commenced within one (1) year after the claim or cause of action arises. If for any reason a court of competent jurisdiction finds any provision of these Terms and Conditions, or a portion thereof, to be unenforceable, that provision shall be enforced to the maximum extent permissible so as to effect the intent of these Terms and Conditions, and the remainder of these Terms and Conditions shall continue in full force and effect. Any failure by Prestige to enforce, or the delay by us to enforce, any right granted herein shall not be deemed a continuing waiver or a modification by us of any such right and Prestige may, within the time provided by applicable law, commence appropriate legal or equitable proceedings to enforce any or all rights granted herein, and any prior failure to enforce or delay in enforcement shall not constitute a defense.

Arbitration By using this Website, you agree that: (1) any claim, dispute or controversy you may have, as an individual or as part of a class action, against Prestige arising out of, relating to, or connected in any way with these Terms and Conditions, the Services provided or request, Prestige employees, officer and agents, this Website, or the purchase or sale of any product or service through this Website, shall be resolved exclusively by final and binding arbitration administered by the American Arbitration Association (“AAA”) and conducted before a single arbitrator pursuant to the applicable Rules and Procedures established by AAA (“Rules and Procedures”); (2) the arbitration shall be held at a location determined by AAA pursuant to the Rules and Procedures (provided that such location is reasonably convenient for you), or at such other location as may be mutually agreed upon by you and Prestige; (3) the arbitrator shall apply New Jersey law consistent with the Federal Arbitration Act and applicable statutes of limitations, and shall honor claims of privilege recognized at law; (4) there shall be no authority for any claims to be arbitrated on a class or representative basis; arbitration can decide only your and/or Prestige’s individual claims; and the arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated; and (5) with the exception of subpart (4) above, if any part of this arbitration provision is deemed to be invalid, unenforceable or illegal, or otherwise conflicts with the Rules and Procedures established by AAA, then the balance of this arbitration provision shall remain in effect and shall be construed in accordance with its terms as if the invalid, unenforceable, illegal or conflicting provision were not contained herein. If, however, subpart (4) is found to be invalid, unenforceable or illegal, then the entirety of this Arbitration Provision shall be null and void, and neither you nor Prestige shall be entitled to arbitrate their dispute. No Jury TrialYou unconditionally waive your right to a jury trial.

Construction If for any reason a court of competent jurisdiction finds any provision of these Terms and Conditions, or a portion thereof, to be unenforceable, that provision shall be enforced to the maximum extent permissible so as to affect the intent of these Terms and Conditions, and the remainder of these Terms and Conditions shall continue in full force and effect.

Entire AgreementThese Terms and Conditions constitutes the entire agreement between Prestige and you with respect to this Website and it supersedes all prior or contemporaneous communications, agreements and understandings between Prestige and You with respect to the subject matter hereof.
